What counts as an Arizona ADU?

Arizona defines an accessory dwelling unit as a self-contained unit on the same lot as a larger single-family home, with sleeping, sanitation and possibly a kitchen. Here, casita, guest house, tiny home and prefab ADU mean the same thing. Arizona treats park model trailers on wheels differently; this page excludes them.

A modular ADU is factory-built to the International Residential Code, the same residential code used for site-built houses. Irontown supplies engineered, stamped plan sets. Trucks deliver the modules, and a crane sets them on a permanent foundation. The completed home is real property.

Where can you build a casita?

State law sets minimum allowances; local rules still need attention. Before ordering, confirm requirements with your city or county planning and building office, and septic with the county health department. Include zoning, permits, fees, HOA rules and compliance in your review.

Before ordering, you must confirm your parcel, model and use with city or county planning and building offices, and septic approval with the health department. We strongly recommend contacting those offices. MCO can share the code sections it found and suggest questions.

What Arizona law guarantees

A.R.S. 9-461.18 binds cities and towns over 75,000 people. A.R.S. 11-810.01 binds every county for unincorporated land. Smaller municipalities set their own rules. Statutory airport and tribal-land exclusions apply.

  • Bound cities and all counties must permit one attached and one detached ADU without a hearing wherever single-family homes are allowed: 9-461.18(A.1), 11-810.01(A.1).
  • The size floor is 75 percent of the house or 1,000 sq ft, whichever is less; the ADU stays smaller: 9-461.18(A.3), 11-810.01(B).
  • ADUs may reach house-zone heights; side and rear setbacks cannot exceed 5 ft. No extra parking or matching design required: 9-461.18(B.3 to B.6), 11-810.01(C.3 to C.6).
  • Long-term rental cannot be barred; no family-relationship rule. Short-term rental may require owner residency for ADUs completed from September 14, 2024: 9-500.39(B.9), 11-269.17(B.9).
  • City development fees are capped; counties have no ADU cap. Fire sprinklers cannot be required: 9-463.05(U), 11-1102, 9-461.18(D), 11-810.01(E).
  • Irontown supplies stamped plans; the local building department reviews site work. Arizona’s factory-built building program covers state plan approval, factory inspection and module certification: 41-4006.

Arizona city rules

Cities and towns over 75,000 people must follow the state ADU law; smaller municipalities follow their own codes. These September 2026 findings describe local allowances, conditions and gaps.

State law requires every county and every city over 75,000 people we read to allow a detached ADU, subject to statutory exclusions. Rows marked “Allowed with conditions” identify local gates; “Ask first” identifies unresolved rules. State law applies where local code has not caught up. We could not read current ADU codes for Goodyear, Show Low, Kingman and Maricopa.

How big can your ADU be?

The state floor is 75 percent of the house’s interior habitable area or 1,000 sq ft, whichever is less. Cities and counties may allow more, but the ADU must remain smaller than the house. Local caps include Cottonwood’s 1,200 sq ft, Pima County’s 1,250 and Navajo County’s house-size limit.

Under 1,000 sq ft: Mysa 500, Cabana 500, Sledhaus 500, Cabana 700, Torrey Flats, Morada 800 and Morada 1000 (989). Rabbit 1000 (1,002) and Walker (1,165) need a higher local cap. House size still matters. Heights and stories follow the house’s zone unless local rules say otherwise; Rabbit has two stories.

Home price and Arizona delivery

The Multi-State starting price includes Designer finishes, module delivery and standard crane set on your foundation for the first 250 miles from Spanish Fork. All of Arizona lies beyond those miles. Approximate extra transportation per load: Flagstaff $2,800, Phoenix $4,600 and Tucson $6,000. Pilot cars cost extra when required.

Beyond 250 miles the rate is $12.75 per mile per truckload; plans wider than about 15 ft and two-story plans usually ship as two modules, and your quote confirms the count. Foundation, site work, stitch, utilities, permits, fees, engineering, pilot cars and sales tax are not included.

Beyond 250 miles, transportation costs $12.75 per mile per truckload. Single-module plans use one load; larger plans arrive as two modules on two trucks, then are stitched on the foundation. Use the calculator’s truckloads selector. Your written quote confirms loads, pricing, finishes, transportation and tax treatment.

Costs not in the home price

These additional costs are quoted by your general contractor, the city and the state, not MCO, and come on top of the home price.

City impact fees: lesser of 25% of total fees or the home’s proportionate share; water/wastewater limited to incremental demand (9-463.05 U). Counties have no ADU cap. Capacity fees may apply. Published examples: Glendale about $13,000; Avondale water/wastewater $14,373; Pima roadway $9,149 through September 30, 2026; Scottsdale reviews $131 each; Navajo permit $400 plus 35% review. Ask your city which fees an ADU pays.

A factory-built building sold and set in Arizona falls under prime-contracting transaction privilege tax (42-5075). The dealer or prime contractor is the taxpayer; the setup site determines location, and tax appears separately on your receipt. Irontown’s price excludes tax; your quote explains handling. After set, the county assessor sets the added value of the ADU as new construction. Valuation notice arrives by September 30 of the valuation year, with 25 days to appeal (42-15105).

Living in or renting your casita

The state ADU statutes impose no owner-occupancy or family-relationship rule. Bound cities and counties cannot bar separate long-term rentals of the house or ADU: leases of 90 days or more, or month to month. Smaller-city codes differ; Payson and Lake Havasu City require owner occupancy, while Marana’s current detached guest quarters prohibit rental.

Cities and counties cannot ban short-term rentals outright, but may require permits and owner residency when your ADU’s certificate of occupancy was issued on or after September 14, 2024. Several listed jurisdictions apply that rule. Older county rental restrictions need clarification. HOA covenants still apply and can limit or bar an ADU.

From plans to permits

Irontown’s Arizona Department of Housing licence places Arizona modules in its factory-built building program; feasibility review confirms your project’s plan approval and factory certification.

  • Bound jurisdictions approve permitted uses without hearings. Surprise prints a 30-day completeness review; other local review times are set locally.
  • Irontown supplies engineered, stamped plan sets during pre-construction for your permit application.
  • The Department of Housing approves factory plans and inspects work or uses approved third parties. Modules require Arizona modular certificates before shipping.
  • Your local building department inspects foundation, utilities, set and stitch; it does not re-inspect the certified factory portion (41-4006).
  • Obtain installation permits from the Department of Housing or inspection-agreement jurisdictions, then installation and occupancy certificates; complete applicable septic, wildfire-zone, HOA steps.

Irontown’s three project phases

Local permit review adds time beyond Irontown’s phases. Cities and counties set review schedules; septic, wildfire and floodplain steps can add time. Permit, building or site delays can affect delivery.

  1. Phase 1 Feasibility Review (1 to 2 weeks). $2,000 applied to your final contract; includes virtual site and route reviews, budget, building requirements, schedule and contractor support.
  2. Phase 2 Pre-construction Agreement (2 to 3 months). Irontown visits your site, develops plans, addresses local code requirements, guides finish selections and supplies stamped engineered plans.
  3. Phase 3 Construction and Delivery (12 to 16 weeks). Irontown builds, ships and sets the modules, communicating about permit, building or site delays.

Six steps on your property

Your general contractor handles the on-site work and coordinates with Irontown. The contractor sets the schedule for these steps.

  1. Prepare the site. Evaluate and grade the site, obtain permits and coordinate delivery.
  2. Build foundation and utilities. Follow engineered foundation plans and install water, wastewater, electricity and gas connections.
  3. Receive and set modules. Prepare access, inspect arriving modules and coordinate crane placement.
  4. Join and finish. Connect modules, weatherproof seams, finish surfaces and connect and test building systems.
  5. Inspect and hand over. Complete inspections, system testing, punch list and walkthrough; hand over documents and keys.
  6. Support after move-in. Arrange warranty service and maintenance scheduling help when wanted.

Your on-site general contractor

A licensed general contractor is required for on-site work and prices it separately from the home. Irontown has connections to some general contractors; contact MCO to see whether we can recommend one for your area. Irontown’s feasibility review includes contractor support.
