What counts as an ADU in Colorado?

Colorado defines an accessory dwelling unit as an internal, attached or detached unit on the primary home’s lot, with complete independent facilities for living, sleeping, eating, cooking and sanitation. Carriage house, backyard cottage, casita, granny flat, tiny home and prefab ADU are everyday names for the same thing here.

A modular ADU is factory-built to the International Residential Code, the same residential code as a site-built house. Engineered, stamped plans guide construction; a crane sets it on a permanent foundation as real property. A wheeled park model, what Colorado law calls a recreational park trailer, is a different product outside this guide.

Where can you build a Colorado ADU?

Your address determines which rules apply. MCO shares code sections and suggested questions. Confirm zoning, permits, fees and HOA rules with local planning before ordering, and septic and wells with the county.

This guide is a starting point. MCO helps and advises but takes no responsibility for zoning, permits, impact fees, septic approval or code compliance. Before ordering, you must confirm your parcel, model and use with city or county planning and building offices, and septic approval with the health department. We strongly recommend contacting those offices. MCO can share the code sections it found and suggest questions.

The state framework: C.R.S. 29-35-403

One statute binds “subject jurisdictions”: cities and towns with 1,000 or more people inside a metropolitan planning organization, and county land within a census designated place of 40,000 or more inside one. Mountain and western towns and most county land follow local codes.

  • Since June 30, 2025, 66 cities and towns across five metropolitan planning regions plus Douglas County’s Highlands Ranch must administratively allow one ADU per detached house without hearings.
  • Subject jurisdictions must allow 500 to 750 sq ft. Smaller or larger sizes, house-size caps, heights and stories remain local choices (29-35-402(18), 29-35-403(3)(c)).
  • Side setbacks cannot exceed the house’s; rear setbacks cannot exceed 5 ft or the accessory-building setback if larger. Larger lot minimums and stricter design rules are prohibited (29-35-402(18)).
  • Owner occupancy is limited to application residency proof or short-term rental licensing. New parking is barred except a narrow case with no off-street parking and prohibited street parking.
  • Factory-built ADUs face no stricter design or size standards; statewide, factory-built structures face no stricter size, floor-space, foundation, setback, side-yard rules than site-built homes since 2025 (30-28-115(3)(b)(I.5), 31-23-301(5)(b)(I.5)).
  • Local controls remain: building, fire, utility, stormwater, impact fees, short-term rentals, provider capacity statements. Water, sewer, well capacity, qualifying historic property and floodplain exemptions apply (29-35-403).

ADU rules inside city limits

The listed Denver-area, northern Front Range, Colorado Springs-area, Pueblo and Grand Junction cities are subject jurisdictions. Estes Park and the other mountain and western towns follow their own codes. These summaries reflect the rules read in September 2026.

ADU rules on unincorporated county land

The state ADU law binds county land only inside Douglas County’s Highlands Ranch area. Everywhere else, the county’s own code decides. Most counties require water and septic capacity for the added dwelling. A well-served lot needs the well question answered first.

State law requires listed subject jurisdictions to allow detached ADUs on qualifying parcels. Except Loveland, every subject jurisdiction we read adds conditions. Aurora, Parker and Woodland Park have not updated their codes, so ask how they apply state law. Ask Boulder County, El Paso County, Teller County and Park County, which lack general ADU routes. Grand Junction’s code text could not be read.

How big can your ADU be?

Subject jurisdictions must allow the 500 to 750 sq ft band. Smaller and larger units, house-size limits, height and stories remain local. Local caps include 750, 800, 900, 1,000, 1,200 and 1,500 sq ft, or a percentage of your house.

Sledhaus 500 (580 sq ft), Cabana 700 (638 or 718) and Torrey Flats (696) fit the band. Mysa 500 and Cabana 500 are 497 sq ft, needing no 500 sq ft minimum. Morada 800 (793), Morada 1000 (989), Rabbit 1000 (1,002) and Walker (1,165) depend on your local cap.

Home price and delivery to Colorado

The Multi-State starting price includes Designer finishes, module delivery, standard crane and set for the first 250 miles from Spanish Fork. Grand Junction, Fruita and Palisade are inside that allowance. Most other Colorado destinations are beyond it: approximately $900 extra per load to Glenwood Springs, $2,900 to Denver and $3,700 to Colorado Springs.

Beyond 250 miles, transportation costs $12.75 per mile per truckload, plus any required pilot car. Single-module plans take one load; bigger plans arrive as two modules on two trucks, stitched on your foundation. Use the calculator’s truckloads selector. Your written quote confirms loads, pricing, finishes, transportation and tax treatment.

Costs not in the home price

These additional costs come on top of the home price and are quoted by your general contractor, city and county, not MCO.

Impact fees remain local; no state rule exempts ADUs from impact, tap or plant investment fees. Reductions include Loveland through 900 sq ft, Boulder’s affordable housing fee, Westminster and Summit County workforce-covenant permit fees. Longmont, Fort Collins, Castle Rock and Durango charge new-unit fees. Published examples: Longmont impact fees $925 plus $582.58 through 800 sq ft; Castle Rock about $14,700 plus stormwater. Ask your city or county which fees an ADU pays.

Since January 1, 2025, Colorado law exempts a modular home built to the Division of Housing‘s codes from state sales and use tax (39-26-721). Most city and county sales taxes and home-rule city taxes are not covered. Whether your purchase qualifies and which local taxes apply at your address depend on the transaction and appear on your written quote. Your county assessor sets the ADU’s added property value.

Living in or renting your ADU

Subject jurisdictions cannot require owner occupancy beyond application residency proof or short-term rental licensing. Long-term rental is unrestricted by statute; short-term rules are local. Boulder, Longmont, Broomfield, Centennial, Fort Collins, Estes Park and Glenwood Springs bar ADU short-term rentals. In subject jurisdictions, HOAs cannot block ADUs beyond reasonable restrictions (38-33.3-106.5).

Elsewhere, local codes decide. Durango, Jefferson and Arapahoe counties require owner occupancy; Lakewood, Arvada and Thornton still require owner occupancy in their codes, so ask which rule applies. Summit and Pitkin counties impose workforce or employee covenants. Many places prohibit separate sale. Read your HOA declaration before ordering; reasonable restrictions can remain.

Factory approval and local permits

Irontown is a registered factory-built manufacturer with the Colorado Division of Housing. Colorado modules undergo state review; feasibility confirms site loads and plan approval.

  • Reviews take Lakewood 15 days, Grand Junction 2 to 3 weeks, Arvada about 3 weeks, Westminster up to 4 weeks.
  • Irontown supplies stamped, engineered plans designed for your site’s snow load, wind and wildfire zone.
  • The Division or authorized third-party agency approves plans and inspects factory work; each module carries the Division’s insignia of approval.
  • Local building departments permit and inspect foundations, utilities, set and stitch without duplicating state factory review (24-32-3311).
  • Complete applicable septic, well, wildfire-code and HOA steps; local agencies set their timing.

Irontown’s three project phases

Irontown gives these phase durations as its goals. Local permit review adds time, and site or building delays can affect the schedule. Your city and contractor set timings for their work.

  1. Phase 1 Feasibility Review (1 to 2 weeks). $2,000 credited to your final contract; includes virtual site and route review, budget, schedule, building requirements and contractor support.
  2. Phase 2 Pre-construction Agreement (2 to 3 months). Site visit, detailed planning, limited customization, site design loads, interior selections and stamped engineered permit plans.
  3. Phase 3 Construction and Delivery (12 to 16 weeks). Irontown builds, ships and sets your modules, with communication about permit, building or site delays.

  1. Prepare and coordinate. Evaluate and prepare the site, obtain permits and coordinate delivery with Irontown.
  2. Build foundation and utilities. Build the engineered foundation and install water, sewer, electrical and gas connections.
  3. Receive and set modules. Prepare access, inspect arriving modules and coordinate crane placement on the foundation.
  4. Join and finish. Connect modules, weatherproof seams, finish surfaces and connect and test building systems.
  5. Inspect and hand over. Complete inspections, system testing, punch list and walkthrough; hand over documents and keys.
  6. Support after move-in. Address warranty issues and help arrange maintenance schedules if wanted.

  3. Confirm locally. Confirm zoning, permits, fees and HOA rules with local planning before ordering, and septic and wells with the county.
  4. Start feasibility. Review your site, delivery route, budget and contractor needs with Irontown.
  5. Finalize your project. Complete pre-construction selections and agreements, then coordinate permits, site preparation, construction and delivery.

Common Questions

Subject jurisdictions must allow one through administrative approval with a detached house on qualifying parcels. Exempt parcels and local standards still matter. Mountain and western towns outside those jurisdictions follow their own codes; a state rule is not a permit.

Subject jurisdictions must allow the 500 to 750 sq ft band. Smaller and larger units depend on local rules, sometimes tied to house size. Height remains local. The 497 sq ft plans need a code that accepts units below 500.

Subject jurisdictions cannot require you to live onsite beyond application residency proof or short-term rental licensing; statute leaves long-term rentals unrestricted. Some codes disagree, so ask. Elsewhere, owner occupancy or workforce covenants may apply. Short-term rental rules are local.

There is no single published total. Add your general contractor’s site-work quote, local fees and applicable taxes to the home and transportation price. The home quote includes delivery and standard crane set for the first 250 miles.

Irontown lists 1 to 2 weeks for feasibility, 2 to 3 months for pre-construction and 12 to 16 weeks for construction and delivery. Local permit review adds time. Site readiness, agency reviews and building delays can change the schedule.
