What counts as a Montana ADU?

Montana defines an accessory dwelling unit as a self-contained living unit on the same parcel as a larger single-family dwelling, with its own cooking, sleeping and sanitation facilities. Mother-in-law suite, guest house, backyard cottage, casita, granny flat, tiny home and prefab ADU are everyday names for the same thing.

A modular ADU is factory-built to the International Residential Code, with engineered stamped plan sets, then set by crane on a permanent foundation as real property. A park model on wheels or any tiny home on wheels is a different product outside this guide.

Where can you put a modular ADU?

Start with zoning, permits, fees, covenants and code compliance. Before ordering, confirm zoning, permits, fees and covenants with local planning, and septic and well capacity with your county sanitarian. MCO shares code sections and suggested questions.

This guide is a starting point. MCO helps and advises but takes no responsibility for zoning, permits, impact fees, septic approval or code compliance. Before ordering, you must confirm your parcel, model and use with city or county planning and building offices, and septic approval with the health department. We strongly recommend contacting those offices. MCO can share the code sections it found and suggest questions.

Montana’s city and county ADU laws

MCA 76-2-345 binds every municipality since January 1, 2024; Montana’s Supreme Court upheld it March 17, 2026. Section 76-2-215 binds county land zoned under the county zoning part since October 1, 2025. Unzoned county land has no zoning rule.

  • Every city and town must allow at least one ADU by right on a single-family dwelling lot. Its ADU application fee cannot exceed $250.
  • The municipal cap is 1,000 sq ft or 75 percent of the house’s gross floor area, whichever is less. A city may allow more.
  • Municipalities cannot require owner occupancy, family relationships, parking, design matching, impact fees or restrictive covenants. Water and sewer will-serve letters remain possible; short-term rental rules stay local.
  • Counties that zone under the county zoning part must allow one ADU by right. DEQ provides 15-day expedited sanitation review where existing public water and wastewater service has capacity.
  • Building, fire, health codes and private covenants remain. Unzoned land retains septic permits, applicable state sanitation review, state electrical and plumbing permits, and floodplain rules.
  • The Department of Labor and Industry reviews model plans and a state-approved agency inspects factory work; approved units need only local zoning, utility and foundation checks.

Every municipality must allow detached ADUs; some codes still print older rules the state law overrides, so ask the city how it applies the law now. How large can your ADU be?

Cities must allow up to 1,000 sq ft or 75 percent of the house’s gross floor area, whichever is less. Bozeman, Missoula, Red Lodge and Sidney publish broader allowances. State law sets no height or story cap; zoned counties set size caps. Walker’s 1,165 sq ft needs a broader local allowance.

House minimums at 75 percent (sq ft): 497 needs 663, 580 needs 774, 638 needs 851, 696 needs 928, 718 needs 958, 793 needs 1,058 and 989 needs 1,319. The Rabbit 1000 is 1,002 sq ft, 2 sq ft over: ask how the office measures floor area.

Home price and delivery to Montana

Multi-State starting prices include Designer finishes, module delivery and standard crane set for the first 250 miles from Spanish Fork. All Montana lies beyond them. Approximate extra transportation per load: West Yellowstone $1,500; Bozeman $2,700; Missoula $4,100; Billings $4,500; Kalispell $5,500.

Beyond 250 miles, delivery costs $12.75 per mile per truckload, plus a pilot car if the permit requires it. Single-module plans use one load; bigger plans arrive as two modules on two trucks, stitched on your foundation. The calculator has a truckloads selector. Your written quote confirms loads, pricing, finishes, transportation and tax treatment.

Costs not in the home price

These costs come on top of the home price and are quoted by your general contractor, city and county, not MCO.

Cities and counties that zone under the county zoning part cannot assess ADU construction impact fees. Application fees cap at $250, plus usual building, review and inspection fees. Utility connection, capacity and system development charges remain local under 7-6-1601. Dillon publishes $725 water and $1,120 sewer development charges. Bozeman still prints impact fees; ask how the ban applies. Water and sewer connections can be the largest fee item. Ask your city or county which fees an ADU pays.

The Montana Department of Revenue states that Montana does not have a general-use sales tax. Nightly rentals under 30 days pay state lodging taxes. A modular home on a permanent foundation is real property; the county assessor sets its added value for property tax. Your written quote shows any tax that applies to the sale.

Living in or renting your ADU

Cities and counties that zone under the county zoning part cannot require owner occupancy or family relationships. The statutes leave long-term rental terms and separate sale unaddressed. Short-term rental rules stay local; stays under 30 days pay lodging taxes. Private covenants and HOA restrictions are preserved, so read your declaration before ordering.

Belgrade still prints owner occupancy. Polson prints owner occupancy and a deed restriction when renting. Lake County districts include rental bans or owner occupancy; Kalispell prohibits rentals under 30 days. Montana’s Supreme Court upheld the city ADU law in 2026. Ask how each office applies it now.

Plans, factory review and site permits

  • Irontown Homes (KEB Homes LLC) is on the Department of Labor and Industry’s approved factory-built building manufacturer list.
  • Certified departments permit and inspect foundations, utilities, set and stitch; elsewhere state electrical, plumbing and county septic permits are gates.
  • Complete applicable septic, sanitation review, well, floodplain, wildfire and covenant steps. Septic approval is separate from zoning; resolve well capacity early.

Irontown’s timeline

Irontown gives these durations for its three phases. Local permit review adds time. Septic, sanitation review, site readiness and weather can affect delivery; your city and contractor set their own schedules.

  1. Phase 1 Feasibility Review (1 to 2 weeks). A $2,000 review, credited to the final contract, covers site access, route, budget, requirements, schedule and contractor support.
  2. Phase 2 Pre-construction Agreement (2 to 3 months). Irontown visits your site, develops stamped plans, addresses site loads and helps you select finishes.
  3. Phase 3 Construction and Delivery (12 to 16 weeks). Irontown builds, ships and sets the modules, communicating any permit, building or site delays.

Six steps on your property

Your general contractor coordinates site work with Irontown’s delivery and crane set. The contractor sets the schedule for these steps.

  1. Pre-construction. Evaluate and prepare the site, obtain permits and coordinate delivery.
  2. Foundation and utilities. Build the engineered foundation and install utility connections.
  3. Module delivery and installation. Prepare access, inspect arriving modules and coordinate crane placement.
  4. Stitching and finishing. Connect modules, finish seams, weatherproof and connect building systems.
  5. Post-construction. Complete inspections, system testing, punch list and your walkthrough.
  6. Ongoing support. Arrange warranty service and maintenance guidance when needed.

You need a general contractor

On-site work requires a general contractor licensed by Montana’s Department of Labor and Industry, priced separately. Registration became a Department licence January 1, 2026. Irontown has connections to some contractors; contact MCO to see whether we can recommend one for your area. Its feasibility review includes contractor support.

Common Questions

Every city and town must allow at least one ADU by right on a lot with a single-family house, including detached units. State law is not a permit for your particular plan. Building, health and covenant rules still apply.

The municipal guarantee reaches 1,000 sq ft or 75 percent of your house’s gross floor area, whichever is less. Cities may allow more. Counties that zone under the county zoning part set their own caps; unzoned land has no zoning size cap.

City law and the county law, where a county zones, prohibit owner-occupancy requirements. Short-term rental rules remain local, and private covenants remain relevant. Some published codes still print owner occupancy or rental restrictions; ask the office which rules it applies.

There is no single project total. Add your home’s quoted price and transportation to your contractor’s site-work quote, applicable permits, utility charges and tax. MCO quotes the home through Irontown; your contractor and local offices price the other work.

Irontown lists 1 to 2 weeks for feasibility, 2 to 3 months for pre-construction, and 12 to 16 weeks for construction and delivery. Local permit review adds time, and site or sanitation requirements can affect the schedule.
